Recommendation:  Approve Resolution 26-XXX, accepting the EarthTones Gifts, Gallery and Center for Healing proposal for the commercial property 790 Pine Street, attached hereto as Exhibit A, authorizing the City Manager to execute leasing agreements, subject to any minor, technical, or non-substantive changes approved by the City Attorney and consistent with Council’s intent.

CEQA Determination: The City finds that this action is exempt from review  under the California Environmental Quality Act pursuant to State CEQA Guidelines Sections 15306, Information Collection, and 15262, Planning Studies.
Recommendation:  Approve Resolution 26-XXX, adopting the 2025-2030 Paso Robles Local Hazard Mitigation Plan and finding this action exempt from CEQA review pursuant to CEQA Guidelines Section 15306 and 15262.

Dwayne Brown, Maintenance Services Superintendent
CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:
It is recommended that the City Council take the following actions:
1. Approve Resolution 26-XXX (A), initiating proceedings for the annual levy of assessments for the maintenance of Landscape & Lighting Maintenance District facilities.
2. Approve Resolution 26-XXX (B), initiating proceedings for the annual levy of assessments for the maintenance of Drainage Maintenance District facilities.
3. Approve Resolution 26-XXX (C), adopting the draft preliminary Landscape & Lighting Maintenance District Engineer’s Levy Report as presented and making it available to the public for review and comment.
4. Approve Resolution 26-XXX (D), adopting the draft preliminary Drainage Maintenance District Engineer’s Levy Report as presented and making it available to the public for review and comment.
5. Approve Resolution 26-XXX (E), declaring the intent to levy for maintenance of the Landscape & Lighting Maintenance District facilities and cause a Notice to be published for a Public Hearing to be scheduled June 2, 2026.
6. Approve Resolution 26-XXX (F), declaring the intent to levy for maintenance of the Drainage Maintenance District facilities and cause a Notice to be published for a Public Hearing to be scheduled June 2, 2026.

David LaCaro, Public Works Operations Manager
CEQA: The City finds that executing a 4-year Maintenance Service Agreement with Bear Electrical Solutions (BES)  is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 1 exemption, which applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing structures, facilities, mechanical equipment, or topographical features where the project involves negligible or no expansion of existing or former use.  (State CEQA Guidelines, § 15301.)  Further, the City finds that none of the exceptions to the Class 1 exemption apply. 
Recommendation: Approve Resolution 26-XXX, authorizing the City Manager to execute a 4-Year Maintenance Service Agreement, subject to legal counsel review, with Bear Electrical Solutions (BES) to provide citywide Traffic Signal Maintenance Services in an amount not to exceed $574,400.

Ditas Esperanza, Capital Projects Engineer
CEQA Determination: In 2021 the City adopted a Mitigated Negative Declaration for the 24th Street Bridge Replacement Project. 
NEPA Determination: Caltrans has determined that this project has no significant impacts on the environment as defined by NEPA, and that there are no unusual circumstances as described in 23 CFR 771.117(b). As such, the project is categorically excluded from the requirements to prepare an EA or EIS under NEPA and is included under the following: 23 USC 326: Caltrans has been assigned, and hereby certifies that it has carried out the responsibility to make this determination pursuant to 23 USC 326 and the Memorandum of Understanding dated April 18, 2019, executed between FHWA and Caltrans. Caltrans has determined that the project is Categorical Exclusion under 23 CFR 771.117(c): activity (c)(28).
Recommendation:  Approve Resolution 26-XXX, authorizing the City Manager to enter into a Public Highway Overpass Agreement with Union Pacific Railroad (UPRR) for the 24th Street Bridge Project

CEQA Determination: The City finds that this action is exempt from the provisions of the California Environmental Quality Act (CEQA) in accordance with the CEQA Guidelines Section 15304 – Class 4, Minor Alterations to Land.
Recommendation:  Approve Resolution 26-XXX, authorizing the removal of one 38-inch Valley Oak tree and require mitigation oak trees by planting two mitigation trees on site and/or provide payment for each tree to the City Oak Replacement Fund at a cost of $200 each.

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Hold the public hearing and receive and file this report in compliance with AB 2561.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 26-XXX, determining that Public Convenience will be served by the issuance of a Type 21 ABC License for Trader Joes located at 2457 Golden Hill Road.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 26-XXX, determining that Public Convenience will be served by the issuance of a Type 21 ABC License for the business to be located at 2401 Golden Hill Road.

Darcy Delgado, Associate Planner
CEQA Determination:  The proposed ordinance is not subject to the California Environmental Quality Act (CEQA) because it does not qualify as a “project” under CEQA. State CEQA Guidelines §15060(c) provides that “[a]n activity is not subject to CEQA if … the activity is not a project as defined in Section 15378.” Even if the proposed ordinance is considered a “project” subject to CEQA, it is categorically exempt pursuant to State CEQA Guidelines Section 15320 (Class 20).
Recommendation:  Introduce for first reading by title only Ordinance XXXX, amending Chapter 21.52 of the Paso Robles Municipal Code.

Darcy Delgado, Associate Planner
CEQA Determination:  On February 20, 2024, the City adopted a Mitigated Negative Declaration (MND) for a commercial/industrial project (“Covelop”) consisting of 240,000 square feet of floor area spanning six buildings for this project site. Staff recommends the City Council approve an addendum to the 2024 MND for the original Covelop project. The Addendum is the appropriate document under CEQA to analyze the consistency of the residential Project with the type and intensity of development previously analyzed for the site in the MND as provided for in CEQA Guidelines section 15162 and 15164.
Recommendation:  It is recommended that City Council approve the project by taking the following actions:
a. Approve Resolution 26-XXX(A), certifying an Addendum to a Mitigated Negative Declaration for Planned Development 25-14, Rezone 25-03, Modification 26-04, Vesting Tentative Tract Map 3255, Conditional Use Permit 25-05, and Oak Tree Removal 25-09; and
b.  Introduce for first reading, by Title only, Ordinance XXXX, approving Rezone 25-03 regarding updates to the El Paso de Robles Zoning Code and Zoning Map; and
c. Approve Resolution 26-XXX(B), approving an allocation of 154 Surplus Density Units to Parcel 025-362-050; and
d. Approve Resolution 26-XXX(C), approving Planned Development 25-14, Conditional Use Permit 25-05, and Modification 26-04; and
e. Approve Resolution 26-XXX(D), approving Vesting Tentative Tract Map 3255; and
f. Approve Resolution 26-XXX(E), approving Oak Tree Removal 25-09.

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve second reading by title only and adopt Ordinance 1168 authorizing an amendment to the contract between the City of Paso Robles and the Board of Administration of the California Public Employees' Retirement System for the MGMT police and fire safety member categories.

Angelica Fortin, Community Services Director
CEQA Determination: The City finds that this action, to approve the preparation of design documents and the finalization of traffic and environmental reports for the Larry Moore Park is exempt from the California Environmental Quality Act (“CEQA”) as CEQA does not apply to feasibility or planning studies that will have no legally binding effect on later activities and will not approve the construction and operation of the Park. (CEQA Guidelines § 15262).
Recommendation:  Approve the Larry Moore Park Concept Plan, direct staff to complete the design documents, and find this action exempt from CEQA pursuant to State Guidelines Section 15262.

CEQA: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation: Approve Resolution 26-XXX approving the San Luis Obispo County Regional Homelessness and Affordable Housing Compact and receive the Regional Homeless Services Inventory.

Darren Nash, City Planner 
CEQA Determination:  An Environmental Impact Report (SCH 2019011065) was adopted for the Olsen South Chandler Specific Plan (Res. 20-024) including Exhibit B to the EIR, Mitigation Monitoring and Reporting Plan (MMRP) in accordance with the California Environmental Quality Act (CEQA). Mitigation measure BIO-4(b) outlines required mitigation for oak trees removed to construct the OSCSP. Should the oak tree removal request be denied that action would not be a project under the California Environmental Quality Act, pursuant to State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 26-XXX, authorizing the removal of Oak Tree No. 903 based on the Arborist’s determination that the tree is in poor health and the proposed improvements for Hanson Road will cause significant impacts to Tree No. 903, and meets finding 10.01.050.D.1, based on the finding that the condition of the tree with respect to general health, status as a public nuisance, danger of falling, proximity to existing or proposed structures, or interference with utility services, and require mitigation trees as required by the project EIR mitigation measures.
