The City has returned to hybrid public meetings pursuant to AB 361, which allows for a deviation from the teleconference rules required by the Ralph M. Brown Act. Residents now have the option to attend the meeting in person or to participate remotely.  To participate remotely, residents can livestream the meeting at www.prcity.com/youtube, and call (805)865-7276 to provide public comment via phone. The phone line will open just prior to the start of the meeting and remain open throughout the meeting to ensure the opportunity to comment on each item heard by the Council.

Written public comments can be submitted via email to cityclerk@prcity.com prior to 12:00 noon on the day of the Council meeting to be posted as an addendum to the Agenda. If submitting written comments in advance of the meeting, please note the agenda item by number or name. 

City Council meetings will be live-streamed during the meeting and also available to play later on YouTube by accessing the following link:  www.prcity.com/youtube.

Any writing or document pertaining to an open session item on this agenda which is distributed to a majority of the City Council after the posting of this agenda will be available for public inspection at the time the subject writing or document is distributed.  The writing or document will be available for public review in the City Clerk’s Office, 1000 Spring Street, Paso Robles, CA, during normal business hours, and may be posted on the City’s web site at www.prcity.com/meetings.

This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2).

ITEMS ON THE CONSENT CALENDAR ARE CONSIDERED ROUTINE, NOT REQUIRING SEPARATE DISCUSSION. However, if discussion is wanted by a member of the Council or public the item may be removed from the Consent Calendar and considered separately. Councilmembers and members of the public may offer comments or ask questions of clarification without removing an item from the Calendar. Individual items are approved by the vote that approves the Consent Calendar unless an item is pulled for separate consideration.  Items pulled from consent will be heard at the end of the meeting.

CEQA Determination: The City find that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.
Recommendation: Reaffirm Resolution 23-018 allowing for the continuation of hybrid remote (teleconference)/in-person public meetings citywide pursuant to the requirements of AB 361.

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State CEQA Guidelines §§ 15060, subd. (b)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX, affirming the classifications of Fire Chief, Deputy Fire Chief, Fire Battalion Chief, Fire Captain/Paramedic, Fire Captain/EMT, Fire Engineer/Paramedic, Fire Engineer/ EMT, Firefighter/Paramedic, Firefighter/EMT, Fire Protection Specialist I, and Fire Protection Specialist II to receive portal-to-portal pay and overtime consistent with the classifications Memorandum of Understanding.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State CEQA Guidelines, § 15304 for minor alterations to land.
Recommendation:  Approve Resolution 23-XXX, approving OTR 23-02, authorizing the removal of a hazardous Coast Live Oak and replacing it with 3 24-inch box Coast Valley Oaks on public property.

Dwayne Brown, Maintenance Services Superintendent
CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.
Recommendation:  
1.    Approve Resolution 23-XXX, authorizing the City Manager to enter into a contract with Silver Fox Landscapes, Inc. for a one-year period in the amount of $111,613 per year, with the option to extend by mutual consent in two-year increments for a total of 10 years and find the action exempt from CEQA.
2.    Authorize the City Manager and City Attorney to make minor adjustments to the agreement, if needed, remaining fully consistent with the Council’s intent.

CEQA Determination: The City finds that this action is categorically exempt under the California Environmental Quality Act (“CEQA”) under the Class 1 exemption, which applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing structures, facilities, mechanical equipment, or topographical features where the project involves negligible or no expansion of existing or former use. (State CEQA Guidelines, § 15301.
Recommendation:  Approve Resolution 23-XXX, authorizing the City Manager to execute a contract to VSS International, Inc. for the City’s annual west side slurry seal maintenance project, in the amount of $548,000.

CEQA Determination:  The City finds that this informational report to the City Council is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378(b)(5).  The action is an administrative activity of the City that involves only a report to a State agency on progress regarding the General Plan Implementation.  The report does not authorize any development or changes to land use. Thus, the report would not result in any direct or indirect changes to the environment, and consequently, this is action is not a project within the meaning of CEQA.
Recommendation:  Approve the 2022 General Plan Annual Report, determine the action is exempt from CEQA for the reasons set forth herein, and direct staff to submit it to the California Department of Housing and Community Development.

CEQA Determination: The City Council is being asked to adopt a mitigated negative declaration (SCH 2023030497) (MND) and Mitigation Monitoring and Reporting Plan (MMRP) for the project, which was circulated between Friday, March 17, 2023 and Tuesday, April 5, 2023.
Recommendation: That the City Council take the following actions:
a.    Approve Resolution 23-XXX(A) certifying mitigated negative declaration SCH 2023030497and adopting the Mitigation Monitoring and Reporting Plan;
b.    Approve Resolution 23-XXX(B) approving Planned Development 22-08 and Oak Tree Removal 22-16.

CEQA Determination: The City Council is being asked to adopt a mitigated negative declaration (MND) and Mitigation Monitoring and Reporting Plan (MMRP) for the project, which was circulated between Friday, March 24, 2023 and Tuesday, April 12, 2023.
Recommendation:  That the City Council take the following actions:
a.    Approve Resolution 23-XXX(A) certifying the mitigated negative declaration and adopting the Mitigation Monitoring and Reporting Plan;
b.    Approve Resolution 23-XXX(B) approving Planned Development 22-13, Conditional Use Permit 22-13 and Oak Tree Removal 23-01.
