City Council Regular Meeting Agenda

The City has returned to hybrid public meetings pursuant to AB 361, which allows for a deviation from the teleconference rules required by the Ralph M. Brown Act. Residents now have the option to attend the meeting in person or to participate remotely.  To participate remotely, residents can livestream the meeting at www.prcity.com/youtube, and call [phone] to provide public comment via phone. The phone line will open just prior to the start of the meeting and remain open throughout the meeting to ensure the opportunity to comment on each item heard by the Council.

Written public comments can be submitted via email to prior to 12:00 noon on the day of the Council meeting to be posted as an addendum to the Agenda. If submitting written comments in advance of the meeting, please note the agenda item by number or name. 

City Council meetings will be live-streamed during the meeting and also available to play later on YouTube by accessing the following link:  www.prcity.com/youtube.

Any writing or document pertaining to an open session item on this agenda which is distributed to a majority of the City Council after the posting of this agenda will be available for public inspection at the time the subject writing or document is distributed.  The writing or document will be available for public review in the City Clerk’s Office, 1000 Spring Street, Paso Robles, CA, during normal business hours, and may be posted on the City’s web site at www.prcity.com/meetings.

Recommendation:  Approve Resolution 23-XXX appointing Sharon L. Roden to the District 1 Council Seat and have the City Clerk administer the oath of office.

GENERAL PUBLIC COMMENTS

This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2).

Recommendation:  Reaffirm Resolution 23-018 allowing for the continuation of hybrid remote (teleconference)/in-person public meetings citywide pursuant to the requirements of AB 361.

Authorization of a Change Order to JJ Fisher Construction for the Wright Way Improvements Project

CEQA Determination:  A mitigated negative declaration was prepared for the 2004 update to the Airport Master Plan and was certified by City Council on November 16, 2004. The Master Plan envisioned several lots for future development, including the construction of a new cul-de-sac road, Wright Way, which connects to Dry Creek Road. Consistent with the California Environmental Quality Act pursuant to Guidelines Section 15162, no subsequent environmental analysis is required.
Recommendation:  Approve Resolution 23-XXX authorizing the change order to JJ Fisher Construction, in the amount of $186,800 and to appropriate $186,800 from airport fund reserves.

8.

Approval of the Award of Construction Contract to Granite Construction for the Creston Road Corridor Improvements Phase 1 from South River Road to Orchard Drive

CEQA Determination: On July 25, 2018, the Community Development Department adopted the Mitigated Negative Declaration for the project and found that the Project would not have a significant effect on the environment after mitigation consistent with City’s adopted Local CEQA Guidelines.
Recommendation:  Approve Resolution 23-XXX, authorizing the City Manager to award the construction contract to Granite Construction for the Creston Road Corridor Phase 1 project, in the amount of $8,448,751; the construction management services to North Coast Engineering, in the amount of $860,000; and to appropriate $2.4 million from Measure E-12 reserves.

Approval of Award of Contract to AAAA Engineering Contracting, Inc. for the Paso Robles Drainage Improvement Project

CEQA Determination:  The City finds that this action is categorically exempt under the Class 1 exemption, State CEQA Guidelines, Article 19, §§ 15302.
Recommendation:  Approve Resolution 23-XXX, awarding a contract for the Paso Robles Drainage Improvement Project to AAAA Engineering Contracting, Inc. in the amount of $488,954.05 and authorize the City Manager to execute the contract subject to any minor, technical or non-substantive changes as approved by the City Manager and City Attorney.

Approval of an Update to the City’s ISA Certified Arborist List

Recommendation:  Approve Resolution 23-XXX, authorizing the update to the Paso Robles ISA Certified Arborists list as presented in Exhibit A to the attached Resolution.

11.

Approval of OTR 23-07/P23-0034 - Request to Remove a 40-inch Blue Oak Tree - 1517 Olive Street

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX OTR 23-07, authorizing the removal of the 40-inch diameter oak tree and require the replanting of one (1) 1.5-inch dbh Blue oak replacement tree on site, at the direction of the Arborist, or pay $200 in-lieu fee to have the City plant a replacement tree on public property permit PRMC10.01.030(E).

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Receive and file ECHO’s fourth quarter report and direct staff to disburse funds in the amount of $55,500.

Oak Tree Preservation Ordinance (PRMC 10.01.030) Violation / Oak Tree Removal Permit OTR23-10 – One (1) valley oak tree damaged beyond reclamation during construction at 1234 Olive Street / APN 009-034-020

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX, to allow the removal of one valley oak tree and assessing a violation fee and require the owner to plant two (2) valley oak trees on-site and pay an in-lieu/violation fee of $1,000.

Selection of a Mayor Pro Tempore and Review and Update of the City Councilmember Liaison Appointments

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Select a Mayor pro Tempore and appoint the Mayor or any councilmember as the primary/alternate appointee for each respective assignment until such assignments are updated after the November 2024 general municipal election.
