City Council Regular Meeting Agenda

The City has returned to hybrid public meetings pursuant to AB 361, which allows for a deviation from the teleconference rules required by the Ralph M. Brown Act. Residents now have the option to attend the meeting in person or to participate remotely.  To participate remotely, residents can livestream the meeting at www.prcity.com/youtube, and call (805)865-7276 to provide public comment via phone. The phone line will open just prior to the start of the meeting and remain open throughout the meeting to ensure the opportunity to comment on each item heard by the Council.

Written public comments can be submitted via email to [email protected] prior to 12:00 noon on the day of the Council meeting to be posted as an addendum to the Agenda. If submitting written comments in advance of the meeting, please note the agenda item by number or name. 

City Council meetings will be live-streamed during the meeting and also available to play later on YouTube by accessing the following link:  www.prcity.com/youtube.

Any writing or document pertaining to an open session item on this agenda which is distributed to a majority of the City Council after the posting of this agenda will be available for public inspection at the time the subject writing or document is distributed.  The writing or document will be available for public review in the City Clerk’s Office, 1000 Spring Street, Paso Robles, CA, during normal business hours, and may be posted on the City’s web site at www.prcity.com/meetings.

This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2).

ITEMS ON THE CONSENT CALENDAR ARE CONSIDERED ROUTINE, NOT REQUIRING SEPARATE DISCUSSION. However, if discussion is wanted by a member of the Council or public the item may be removed from the Consent Calendar and considered separately. Councilmembers and members of the public may offer comments or ask questions of clarification without removing an item from the Calendar. Individual items are approved by the vote that approves the Consent Calendar unless an item is pulled for separate consideration.  Items pulled from consent will be heard at the end of the meeting.

CEQA Determination: The City find that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX, allowing for the continuation of remote and/or hybrid remote and in-person meetings citywide pursuant to AB 361

CEQA Determination:  The City find that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 150601 subd. (b)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX approving the Continuation of the Local Emergency related to the January Storms and direct staff to continue to take actions as necessary to respond to protect and preserve public welfare and seek reimbursement from State and Federal resources.

CEQA Determination:  The City find that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15061, subd. (b)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX, approving the State of California Governor’s Designation of Applicant’s Agent Resolution allowing the City Manager, the Assistant City Manager, and/or the Director of Administrative Services to apply for and obtain disaster relief and emergency financial assistance on behalf of the City, for costs incurred related to the January 2023 winter storms.

Recommendation:  Receive and file the Annual Development Impact Fee Report for the Fiscal Year Ending June 30, 2022.

CEQA Determination:  The City find that this action is exempt from review under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines Section 15304(e), Minor Alterations of Land, as a temporary use having no permenant effect on the environment
Recommendation:  Approve the request of Sky Performance Athletics and the Paso Robles Bearcat Boosters to stage the Wine Country Classic Street Vault in City Park on August 5, 2023.

CEQA Determination:   The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378. 
Recommendation:  Approve Resolution 23-XXX, authorizing the City Manager to enter into a maintenance service contract with Bear Electrical Solutions (BES) to implement Niblick corridor signal upgrades in an amount not to exceed $220,000.

CEQA Determination: The City find that this action is not a project under the California Environmental Quality Act pursuant to State CEQA Guidelines section 15060, subd. (b)(2)-(3), 15378.
Recommendation: Approve Resolution 23-XXX, summarily vacating, per Streets and Highway Code Section 8333 through 8336, the 15-foot wide Public Sewer Easement that was previously accepted by the City Council on November 18, 2014, as shown on Lot 10, Tract 2805.

CEQA Determination:    The Durable Encroachment Agreement is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 4 exemption, which applies to minor public or private alterations in the condition of land, water, and/or vegetation where the project does not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes (see CEQA Guidelines section 15304).
Recommendation:  Approve Resolution 23-XXX, authorizing the City Manager to enter into a Durable Encroachment Agreement with River Walk LP, attached in substantially final form, for the installation of two-inch water service crossing the east end of Larry Moore Park, and make any necessary modifications to the Agreement in consultation with the City Attorney.

CEQA Determination:  The Olsen–South Chandler Specific Plan and Development Agreement were analyzed as part of the Olsen–South Chandler Specific Plan Final Environmental Impact Report SCH#2019011065. The modifications to the timeline for the Memorandum of Understanding, which was established in accordance with the Development Agreement, have been determined to be consistent with previously approved EIR and associated Mitigation Monitoring and Reporting Program and there are no additional environmental impacts. As such, no additional CEQA review is required.
Recommendation:  Authorize the City Manager to execute Olsen–South Chandler Specific Plan MOU Amendment Memo No. 1.

Recommendation:  Approve Resolution 23-XXX recommending CDBG allocations for the City’s One-Year Action Plan to the County of San Luis Obispo as follows:

CEQA Determination:  The City Council determined the project was Categorically Exempt from environmental review per Section 15332 (Infill) of the State’s Guidelines to Implement the California Environmental Quality Act (CEQA) as part of City Council Resolution 21-145.
Recommendation:  The Planning Commission is recommending Option 1 - to remove Condition No. 16. From the project.
