Written public comments can be submitted via email to  prior to 12:00 noon on the day of the Council meeting to be posted as an addendum to the Agenda. Any writing or document pertaining to an open session item on this agenda which is distributed to a majority of the City Council after the posting of this agenda will be available for public inspection at the time the subject writing or document is distributed. GENERAL PUBLIC COMMENTS

This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2).

Second Reading and Adoption of an Ordinance Amending Section 3.28.390 of the Paso Robles Municipal Code: Business License Tax – Sidewalk Vendor

Recommendation:  Hold the second reading of and adopt Ordinance 1136 amending Section 3.28.390 of the City of El Paso de Robles Municipal Code, Business License Tax – Sidewalk Vendors.

Approve the Annexation of, and Introduce for First Reading an Ordinance Authorizing the Levy of Special Taxes for, River Oaks II Phases 2 through 5 into Community Facilities District No. 2005-1

Recommendation:
1. Approve Resolution 24-XXX, approving Annexation No. 62 of territory within the Future Annexation Area to the City’s Community Facilities District No. 2005-1; and
2. Introduce for first reading, by title only, Ordinance N.S. XXXX, authorizing the Levy of Special Taxes for River Oaks II Phases 2 through 5 into Community Facilities District No. 2005-1.

Approval of Oak Tree Removal Permit 23-12 at 426 Creston Road

CEQA Determination:  The City finds this action is categorically exempt from CEQA as a class 3 exemption for new construction of small structures including second dwelling units pursuant to State CEQA Guidelines Section 15303.
Recommendation:  Approve Resolution 24-XXX, approving Oak Tree Removal Permit OTR23-12 to allow the removal of one 12-inch live oak tree at 426 Creston Road and require replanting oak trees with diameters totaling 3 inches.

DISCUSSION ITEMS

1.

Introduction and First Reading of an Ordinance Amending Paso Robles Municipal Code Title 2, Chapter 2.40, Bonds and Salaries of Officers, Section 2.40.030(B), Salary - Amounts

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Introduce for first reading by title only, an ordinance of the City Council of the City of El Paso de Robles amending Title 2, Chapter 2.240, Bonds and Salaries of Officers, Section 2.40.030(B) of the Paso Robles Municipal Code, increasing the Mayor and City Councilmember salary to $1,540 and $1,155, respectively.

2.

Fiscal Year 2023-24 Second Quarter Report: El Camino Homeless Organization (ECHO) Memorandum of Understanding and Direction to Staff to Disburse Payment Pursuant to the Memorandum of Understanding

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  It is recommended that the City Council receive and file ECHO’s FY 23-24 second quarter report and direct staff to disburse payment in the amount of $55,500.

Award Park Design and Environmental Services Contracts for Larry Moore Park Redevelopment

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 24-XXX awarding a contract for landscape architecture design services for Larry Moore Park Redevelopment to David Volz Design in the amount of $707,498.00; awarding  a contract for Larry Moore Park Redevelopment CEQA Services to SWCA Environmental Consultants to SWCA Environmental Consultants in the amount of $144,042.86; find the action exempt from CEQA under State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378; and authorize the City Manager to execute both contracts, subject to any minor, technical, or non-substantive changes as approved by the City Manager and the City Attorney.

City Council Position on the Local Roads First Transportation Tax Measure: Adoption of Resolution in Support or Opposition to the Measure
