The City has returned to hybrid public meetings pursuant to AB 361, which allows for a deviation from the teleconference rules required by the Ralph M. Brown Act. Residents now have the option to attend the meeting in person or to participate remotely.  To participate remotely, residents can livestream the meeting at www.prcity.com/youtube, and call (805)865-7276 to provide public comment via phone. The phone line will open just prior to the start of the meeting and remain open throughout the meeting to ensure the opportunity to comment on each item heard by the Council.

Written public comments can be submitted via email to [email protected] prior to 12:00 noon on the day of the Council meeting to be posted as an addendum to the Agenda. If submitting written comments in advance of the meeting, please note the agenda item by number or name. 

City Council meetings will be live-streamed during the meeting and also available to play later on YouTube by accessing the following link:  www.prcity.com/youtube.

Any writing or document pertaining to an open session item on this agenda which is distributed to a majority of the City Council after the posting of this agenda will be available for public inspection at the time the subject writing or document is distributed.  The writing or document will be available for public review in the City Clerk’s Office, 1000 Spring Street, Paso Robles, CA, during normal business hours, and may be posted on the City’s web site at www.prcity.com/meetings.

This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2).

ITEMS ON THE CONSENT CALENDAR ARE CONSIDERED ROUTINE, NOT REQUIRING SEPARATE DISCUSSION. However, if discussion is wanted by a member of the Council or public the item may be removed from the Consent Calendar and considered separately. Councilmembers and members of the public may offer comments or ask questions of clarification without removing an item from the Calendar. Individual items are approved by the vote that approves the Consent Calendar unless an item is pulled for separate consideration.  Items pulled from consent will be heard at the end of the meeting.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15061, subd. (b)(2)-(3), 15378.
Recommendation:  Reaffirm Resolution 23-018 allowing for the continuation of hybrid remote (teleconference)/in-person public meetings citywide pursuant to the requirements of AB 361.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15061, subd. (b)(2)-(3), 15378.
Recommendation: Approve Resolution 23-XXX declaring the properties described in Exhibit A to the resolution as public nuisances in violation of Paso Robles Municipal Code 16.10; and direct the Fire Marshal to post on the property or provide written notice to the property owners of each property identified in Exhibit A of the public hearing to be conducted by the City Council on June 20, 2023.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.
Recommendation:  Approve Resolution 23-XXX, authorizing:
1)    The City Manager to execute the grant agreement with the FAA upon receipt in the amount of $134,000; and
2)    The City Manager to execute a professional services agreement for engineering services with Tartaglia Engineering for the preparation of the PMMP document for an amount not to exceed $117,000; and
3)    The City Manager to execute grant match agreement with Cal Trans Division of Aeronautics; and
4)    Authorize appropriate transfers from the Airport reserves to the Airport budget to fund the project until reimbursement payments are made by the FAA.; and 
5)    The City Manager and City Attorney to make minor, technical, or non-substantive changes to each agreement, as necessary, consistent with the Council’s overall intent.

Freda Berman, Public Works Director 
Recommendation:  Approve Resolution 23-XXX awarding a contract for construction of the Barney Schwartz Park Pump Track to Greenwald Inc DBA Greenwald Builders/Frontier Skateparks in the amount of $502,346.83 and authorize the City Manager to execute the contract, subject to any minor, technical, or non-substantive changes as approved by the City Manager and City Attorney.
CEQA Determination:  The City finds that this action is exempt from review under the California Environmental Quality Act pursuant to State CEQA Guidelines Sections 15301 and 15303.  

Dwayne Brown, Maintenance Services Superintendent
CEQA Determination:  The City finds that this action is exempt from review under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15031.
Recommendation:  
1. Approve Resolution 23-XXX, authorizing the City Manager to enter into a contract with KD Janni for a two-year period beginning in May 2023 in the amount of $162,990 per year, with the option to extend by mutual consent in two-year increments for a total of 10 years and find the action exempt from CEQA pursuant to State CEQA Guidelines Section 15301.
2. Authorize the City Manager and City Attorney to make minor adjustments to the agreement, if needed, remaining fully consistent with the Council’s intent.

Recommendation:  
1.    Approve Resolution 23-XXX (A) Amending and/or Approving the Engineer’s Annual Levy Report for the El Paso de Robles Landscape and Lighting Maintenance District No. 1 for Fiscal Year 2023/24. 
2.    Approve Resolution 23-XXX (B) Amending and/or Approving the Engineer’s Annual Levy Report for the El Paso de Robles Drainage Maintenance District No. 2008-1 for Fiscal Year 2023/24.
3.    Approve Resolution 23-XXX (C) Ordering the Levy and Collection of Assessments within the El Paso de Robles Landscape and Lighting Maintenance District No. 1 for Fiscal Year 2023/24.
4.    Approve Resolution 23-XXX (D) Ordering the Levy and Collection of Assessments within the El Paso de Robles Drainage Maintenance District No. 2008-1for Fiscal Year 2023/24.
