All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Recommendation:  Approve Resolution 24-XXX adopting the amended Conflict of Interest Code.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Affirm the assignment of Youth Commissioners Cole Ammann and Lane Shea, Senior Citizen Advisory Committee member Mara Whitten, and Parks and Recreation Advisory Committee Members Rich Clayton and Diane Zannotti as advisory body liaisons for the State of California’s Statewide Comprehensive Outdoor Recreation Plan Focus Group.

Approval of the Purchase of a Compact Track Loader for the Water Division

Recommendation:  Approve Resolution 24-XXX, authorizing the City Manager to purchase one additional Compact Track Loader for the Water Division as part of the City’s FY 2024/25 Fleet Replacement Program.

Acceptance of Easement for Electrical Line Use for Pacific Gas & Electric

Recommendation:  Approve Resolution 24-XXX, accepting the Grant of Easement for electrical line use for PG&E, and authorizing the City Manager or designee to sign and record the Grant of Easement attached to this agenda item.

Approval of Public Right of Way Easement Purchase – Niblick and South River Road Right Turn

CEQA Determination:  The Grant of Easement and Public Safety and Utility purchase in itself is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment.  (State CEQA Guidelines, §§ 15060, subd. (b)(2)-(3), 15378.) 
Recommendation:  Approve Resolution 24-XXX, accepting the Grant of Easement for public street and utility, and authorizing the City Manager to sign and record the Grant of Easement and Purchase Agreement.

For the City Council to introduce for first reading by title only, a comprehensive Zoning Code Update, amending the Zoning Map including removing special conditions overlays D and E and removing of Hillside District Overlay, and amendments to Municipal Code Titles 2 (Administration and Personnel), 3 (Revenue and Finance), 5 (Permits and Regulations), 7 (Health and Sanitation), 8 (Animal Control), 9 (Public Safety), 10 (Vegetation), 12 (Vehicles and Traffic), 14 (Water and Sewers), 19 (Signs), and 22 (Subdivisions) for consistency with amendments to the Zoning Code.

Recommendation:  The Planning Commission and staff recommend:
City Council introduce for 1st reading by title only the Zone Code text Amendments, Map Amendments, and Municipal Code Title Amendments as follows:

Approval of Short-Term Rental Agreements with Joe’s One-Niner Diner, Soar Paso, and Mercy Air

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 24-XXX authorizing the City Manager or designee to execute the short-term rental agreements with Joe’s One-Niner Diner, Mercy Air, and Soar Paso subject to any minor, technical, or non-substantive changes as approved by the City Manager and City Attorney.

Approval of a Full Service Fixed Based Operator Agreement with Loyd’s Aviation

Recommendation:  Approve Resolution 24-XXX, authorizing the City Manager to execute the lease agreement with Loyd’s Aviation for full Fixed Based Operator Services, subject to any minor, technical, or non-substantive changes as approved by the City Manager and City Attorney and subject to any minor insurance changes approved by the Risk Manager.
