This is the time the public may address the Council on items within the Council’s purview but not scheduled on the agenda. All persons desiring to speak on an agenda item are asked to fill out Speaker Information Cards and give them to the City Clerk prior speaking. Each individual speaker will be limited to a presentation total of three (3) minutes per item. Those persons wishing to speak on any item scheduled on the agenda will be given an opportunity to do so at the time that item is being considered. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. However, if discussion is wanted by a member of the Council or public the item may be removed from the Consent Calendar and considered separately. Councilmembers and members of the public may offer comments or ask questions of clarification without removing an item from the Calendar. Individual items are approved by the vote that approves the Consent Calendar unless an item is pulled for separate consideration.  Items pulled from consent will be heard at the end of the meeting.

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve the second reading by title only and adopt Ordinance No. 1138 N.S., amending Section 2.40.030(B), of Title 2, Chapter 2.240, Bonds and Salaries of Officers, by increasing the salary of the Mayor and City Councilmembers to $1,540 and $1,155, respectively.

CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Appoint Victor Popp to the Visit SLO CAL Board of Directors for the Paso Robles seat, to serve for a three-year term (July 1, 2024, to June 30, 2027).

Kirk Gonzalez, Utilities Engineering Manager 
CEQA Determination: The City prepared an Initial Study and Mitigated Negative Declaration (IS/MND) for the Recycled Water Distribution System project and circulated it for public comment (State Clearinghouse #2018051033). The City certified the IS/MND and filed a Notice of Determination on August 24, 2018. This action is consistent with the previously certified IS/MND. or CEQA Determination: Additionally, the rejection and rebidding  is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Approve Resolution 24-XXX, to (a) reject all bids for the Recycled Water Distribution System Project; (b) reject the bid protests as moot; (c) delegate authority to the City Manager to authorize a budget amendment for Carollo Engineers to provide engineering support for re-advertising; and (d) authorize staff to re-advertise the Project for bids.

Recommendation: Approve the request of the Downtown Paso Robles Main Street Association to stage the Horseless Carriage Club of America Show and Shine event in City Park on May 7, 2024.

Recommendation: Approve the request of the Paso Robles City Library to stage the Summer Reading Program Launch Party in City Park on June 15, 2024.

Mark Scandalis, Airport Manager  
CEQA Determination:  The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378 as the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment.
Recommendation:  Approve Resolution 24-XXX, authorizing the following:
1. The City Manager to execute the grant agreement with the FAA upon receipt, in an amount not to exceed $589,567; and
2. The City Manager to execute a professional services agreement for environmental and planning services with Coffman Associates for assistance with the Airport Master Plan update project for a total amount not to exceed $639,687, with any necessary funding conditions required under the issued FAA grant agreement for the FAA-eligible work; and
3. The City Manager to apply for and execute a grant match agreement with Cal Trans Division of Aeronautics if received; and
4. Authorize and appropriate $639,687 from the Airport Enterprise Fund and Economic Development Fund to prefund the Project prior to release of FAA Grant Funds and acknowledging that the majority of these funds will be reimbursed to the City through the FAA Grant Funds and the Cal Trans grant funds; and 
5. Authorize the City Manager and City Attorney to make minor, technical, or non-substantive changes to the Coffman Associates Professional Services Agreement, as necessary, consistent with the Council’s overall intent and the inclusion of any funding conditions required under the FAA grant agreement.

Recommendation: Approve Resolution 24-XXX, authorizing the City Manager to enter into a construction contract with Specialized Pavement Marking in the amount of $118,423.20  (with a 5% construction contingency for a total project cost of $124,400) for the Annual Pavement Striping and Markers Refreshment project, with the City Manager and City Attorney to make any minor, technical, or non-substantive changes to the contract that are consistent with the Council action.

Recommendation: Approve Resolution 24-XXX, authorizing the City Manager to enter into a construction contract with Westrock General Engineering in the amount of $82,882 for the Centennial Park Parking Lot Maintenance project, plus inspection testing ($15,000) and a 5% contingency, ; appropriate $80,000 from the Facility Replacement Fund; and authorize the City Manager and City Attorney to make any minor, technical, or non-substantive changes to the contract that are consistent with the Council action.

CEQA Determination:  The City finds that this action is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 1 exemption, which applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing structures, facilities, mechanical equipment, or topographical features where the project involves negligible or no expansion of existing or former use (State CEQA Guidelines, § 15301).
Recommendation:  Approve Resolution 24-XXX, authorizing the appropriation of $49,800 from Measure J-20 reserves, and authorize the City Manager to enter into a City construction contract J.L. Plank, Inc. dba Cen-Cal Construction, in the amount of $995,995 (with a 5% contingency for a total project cost of $1,046,000) for road work on 17th Street from Chestnut to Spring Street consistent with Council action.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.
Recommendation:  Introduce, for second reading by title only, and adopt Ordinance 1137 of the City Council of the City of El Paso de Robles acting as the legislative body of the City of Paso Robles Community Facilities District No. 2005-01 (public services), authorizing the levy of special taxes in such community facilities district, including annexation territory.

CEQA Determination: The City finds that this action is not a project under the California Environmental Quality Act pursuant to State Guidelines Section State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378
Recommendation:  Approve Resolution 24-XXX accepting Final Tract Map 3105-2 for Recordation and authorizing execution and recordation of the Final Map for Tract 3105-2, accepting the public offers of dedication listed in the Owner’s Statement, and directing the City Clerk to state the following on the map “I, Melissa Boyer, City Clerk of the City of El Paso de Robles, California, hereby state that the City Council of the aforesaid city did, on 16th of April, 2024, approve the map of Tract 3105 shown hereon, in accordance with the provisions of the Subdivision Map Act and Local Ordinances, and  further that there is accepted on behalf of the public certain public water and sewer easements delineated on this map, public utility easements or “PUE” delineated on this map for public use and benefit of the several public utility companies which are authorized to serve in said subdivision, public gas easements delineated on said map, and emergency fire access easement delineated on said map; and the city also hereby accepts the abandonment of the public utility easement noted on this map; and approving a Subdivision Improvement Agreement, directing the City Manager to sign the Subdivision Improvement Agreement, and authorizing the City Attorney to correct any non-substantive errors in the document.

CEQA Determination:  The Beechwood Specific Plan and Development Agreement were analyzed as part of the Beechwood Specific Plan Final Environmental Impact Report SCH#2018061064, the modifications to the Project detailed in the Operating Memo have been determined to be consistent with the previously approved EIR and associated Mitigation Monitoring and Reporting Program and there are no additional environmental impacts. As such, no additional CEQA review is required.
Recommendation:  Authorize the City Manager to execute Beechwood Specific Plan Operating Memo No. 1.

Recommendation:  Receive and file this report and provide any desired direction on the preparation of the Fiscal Years 2024-25 and 2025-26 budget and approve Resolution 24-XXX, amending the City’s budget for Maintenance and Operations and Capital Appropriations for FY 2023-24, to modify the General Fund ($225,000); ARPA Fund ($444,000) and Airport Fund ($96,000) as outlined in the report.
